§ 1 General, scope of the General Terms and Conditions

1. All deliveries and services are carried out exclusively on the basis of the following general terms and conditions (hereinafter "GTC") in the version valid at the time of the order.
2. The contractual partner is the agency Consimex, represented by the owner Kerstin Tappmeyer, Wulftener Straße 18, 49082 Osnabrück, Germany.
   VAT ID No.: DE 248 3260 41 (hereinafter "Seller").
3. Customers within the meaning of these terms and conditions can be consumers (hereinafter “customer”). Consumers within the meaning of the terms and conditions are natural persons who conclude contracts for a purpose that cannot be attributed to their commercial or professional activity.

§2 Conclusion of the contract, conclusion of the contract

1. The offers and article presentations do not represent a binding offer. Only your order is a binding offer Section 145 Civil Code (BGB), which we can accept. After sending the order, we will first send you an order confirmation by e-mail. The contract is concluded with the dispatch of the goods.
2. When you have found the product you are looking for, you can take a closer look at it without obligation by clicking on the product name or the product image. By clicking on the button [Into the shopping cart] you can place the article in the shopping cart. You can view the contents of the shopping cart without obligation at any time by clicking on the [Shopping cart] button. 3. In the course of the further ordering process, set up a customer account with us when you make your first purchase and select the shipping and payment method. In the last step, you will receive an overview of your order data under "Order information" and you can check all the information again and delete or change it under [Correct]. You can also correct input errors by navigating backwards in the browser or canceling the ordering process and starting from the beginning. To complete the purchase, you must accept our general terms and conditions and press the [Buy] button. This sends the order to us.

§ 3 Storage of the text of the contract

We save your order, the order data entered and the entire text of the contract. We will send you an order receipt and order confirmation by e-mail with all order data and the entire text of the contract.

§ 4 Right of withdrawal for consumers

The following right of withdrawal only applies to consumers in distance selling:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day

• on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered in one go;
• on which you or a third party named by you who is not the carrier took possession of the last goods, if you ordered several goods as part of a single order and these are delivered separately;

In order to exercise your right of withdrawal, you must inform us(Agency Consimex, represented by the owner Kerstin Tappmeyer, Wulftener Straße 18, 49082 Osnabrück, Germany, telephone number: 49 (0)541/76099220, e-mail address: info@consimex.de) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the model cancellation form available for download at the end of this page, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

• If you revoke this contract, we will owe you all payments that we receive from youold, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), to be repaid immediately and at the latest within fourteen days from the day on which we have received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
• You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
• You bear the direct costs of returning the goods.
• You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Reasons for exclusion or expiration

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

The right of withdrawal expires prematurely for contracts

– for the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature;

§ 6 prices and shipping costs

All prices include the statutory VAT plus any shipping costs. We deliver with DPD, DHL or another provider of our choice.

§ 7 Terms of Delivery

1. The terms of delivery can be found in the check out on our shop presence or in the respective offer
2. If you are a consumer, it is regulated by law that the risk of accidental loss and accidental deterioration of the item sold during shipment only passes to you when the goods are handed over to you (regardless of whether the shipment is insured or uninsured). This does not apply if you have independently commissioned a transport company not named by the contractor or another person responsible for carrying out the shipment.

§ 8 Terms of Payment & Retention of Title

1. The payment methods available to you can be found on our shop presence in the check out or in the respective offer.
   
2. Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.
   
3. We retain ownership of the purchased item until complete paymentpayment of the invoice amount.

§ 9 Warranty

If you are a consumer, the warranty is based on the statutory provisions.

Section 10 Liability

We have unlimited liability for intent and gross negligence and in accordance with the provisions of the Product Liability Act. In the case of slight negligence, we are liable for injuries to life, limb and health of persons.

In other cases, we are only liable for slight negligence if essential contractual obligations are violated. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract and on whose compliance the contractual partner trusts. Liability in the event of a breach of such an essential contractual obligation is limited to the contractually typical damage that we had to reckon with when the contract was concluded based on the circumstances known at the time. This limitation of liability also applies to our vicarious agents.

§ 11 Miscellaneous

1. The contract language is German.
2. The European Commission provides a platform for online dispute resolution (OS). This can be reached via the following Internet address: https://ec.europa.eu/consumers/odr/ . We are not willing or obliged to participate in a dispute settlement procedure of the consumer arbitration board.
3. If one or more provisions of these General Terms and Conditions are ineffective, the rest of the contract remains effective. Insofar as the provisions are ineffective, the content of the contract is based on the statutory provisions.
